In a story that is creating a firestorm in the United States, a policy requiring U.S. Border Patrol agents to use non-lethal bean bags as an initial weapon may have led to the murder of a decorated federal agent who was viciously gunned down by a heavily armed group of illegal immigrants in Arizona.

The deadly gun battle took place on December 14, but the Department of Homeland Security has kept details from the public under the often-invoked premise that it’s an “ongoing investigation,” according to officials at Judicial Watch, a Washington-based public interest group.

This week the newspaper, the Arizona Star, obtained FBI files relating to the case and the details are sure to ignite rage among those who favor securing the increasingly violent southern border.

The murdered agent, Brian Terry, and his colleague encountered five illegal border crossers  at around 11:15 p.m. in an area known as Peck Canyon, northwest of Nogales, Arizona. The illegal aliens refused commands to drop their weapons and the two federal agents proceeded to fire beanbags, as per Border Patrol policy to use non-lethal force against illegal aliens entering the U.S.

The illegal immigrants, who were heavily armed with sophisticated assault weapons such as AK-47s, responded to the beanbags with gunfire and agent Terry was mortally wounded — shot in the back. The agents eventually returned fire but it was too late for Agent Terry.

Terry was a member of a highly trained tactical unit (Bortac) that was targeting a violent gang that robbed and assaulted other criminals such as drug runners, human traffickers and illegal aliens.

    That’s the problem….other Agents have been screwed over using JUSTIFIED force, so he probably had that on the back of his mind.
    Also it should be added that all the facts are not yet in. He was shot in the back, so its possible he was using bean bags on a possibly unarmed person who was setting him up for an ambush.

    Well, whether he decided to use a bean bag or not, situation predicts hostile encounters with armed individuals. The rules of Engagements must be studied well. Specially after what has happened. Can’t blame a dead guy right!

    That story is totally inaccurate. In an interview with the local BP union agent that I listened to he said the beanbag policy is not true. Terry chose to use bean bags first…probably because he was concerned about getting in trouble from using lethal force, which is still just as bad as other agents have in the past. Getting thrown under the bus by the Govt. The agent wouldnt get into it any further due to the ongoing investigation. Once again though he did say the media has the bean bag policy wrong.

    Tell me again why our military is not pushing 3 miles into Mexico and creating a DMZ filled with mines, sensors, barbed wire, drones, and armed robots? Oh yeah! It would protect our southern border. Well we can’t have that can we?

Bean bags for our side, no guns for our agents in Mexico…while smuggling guns to Narco Cartels…to make a case against US Gun Owners…..NOT to worry…Holder will investigate.

    The AK47 that Terry was shot with was traced back to an ATF program called Project gunrunner. This is a project in which the ATF ALLOWED straw purchase of weapons in order to have them smuggled into Mexico for drug cartels in HOPES that they could build a case against the cartels. Well, there program cost the life of Terry and the lives many others.
