DAYTONA BEACH, Fla. — An inmate at the Tomoka Correctional Institution raped and killed a prison guard on Wednesday.  Enoch Hall, 39, had been in the facility since 1994, after he was sentenced to life in prison for sexual battery with a weapon and kidnapping charges in 1993.

Officials at the prison said the officer, Donna Fitzgerald, entered a warehouse area at approximately 7:30 p.m. Wednesday evening after lights-out and was attacked after finding Hall hiding.  He was quickly transferred to Florida State Prison Thursday.

    Although the death penalty is not a perfect solution, it is the only one that guarantees there will be no recidivisim.

    With the advent of modern technology the possibility of executing an innocent is vanishingly small.

    To expedite the process all death sentences should have automatic appeals within 60 days of sentencing and execution within one year of the jury’s verdict. To remain on Death Row for more than one year could be a violation of the 8th Amendment.
