A Tucson, Ariz., SWAT team defends shooting an Iraq War veteran 60 times during a drug raid, although it declines to say whether it found any drugs in the house and has had to retract its claim that the veteran shot first.

And the Pima County sheriff scolded the media for “questioning the legality” of the shooting.

Jose Guerena, 26, died the morning of May 5. He was asleep in his Tucson home after working a night shift at the Asarco copper mine when his wife, Vanessa, saw the armed SWAT team outside her youngest son’s bedroom window.

Guerena grabbed his assault rifle and was pointing it at the SWAT team, which was trying to serve a narcotics search warrant as part of a multi-house drug crackdown, when the team broke down the door. At first the Pima County Sheriff’s Office said that Guerena fired first, but on Wednesday officials backtracked and said he had not. “The safety was on and he could not fire,” according to the sheriff’s statement.

SWAT team members fired 71 times and hit Guerena 60 times, police said.

A report by ABC News affiliate KGUN found that more than an hour had passed before the SWAT team let the paramedics work on Guerena. By then he was dead.

    I am still waiting to hear of a lawsuit….Surely this widow is bringing one…What is she waiting for? Make them Pay for this injustice. Needless to say it will not bring him back but it will see that his children do get an education and day to day expenses.

    BT you sound like a spokesperson or attorney for a PD (no offense). Warrant or not, this was what it is. An invasion and a murder of a Marine who ceased to fire. Standards and procedures sounds wonderful. But these guys need to be behind bars or even better just as any other civilian would get. And no word of a single piece of contraband or evidence. Call a spade a spade!

    The lawsuit the widow will bring will result in first the breakup of this swat team and secondly new prodcedures and standards to be followed before a single shot can be fired. We had the same type of tragic situation in Atlanta, but such standards will not be followed until a tragedy happens for some reason. I pray this also does not have to happen in another major city before such standards are carefully managed and changed as society changes.

If they had evidence of narco involvement, then it would have been made known by now. Instead, they murdered/assassinated this guy for doing what any red-blooded Marine would have done. Defend his home from any and all invaders. You can’t convince me that 3-4 guys can shoot 60+ times even on select fire (while he was still standing). Then to let him lie there and die for an hour. Karma is a bitch TPDS! Oh…and he was Hispanic so he must have narco involvement huh. IMHO, he should have closed all visible window openings from “outsiders”. Then again, think as they do, FIRE FIRST, ASK QUESTIONS LATER!

    Casey you sound like a typical cop. Jeff your conclusions are correct. This further seals my cold view of American LEOs and the special treatment they receive when compared to my brothers from real combat theater. A full SWAT detail getting away with cold blooded murder. And a fat Sheriff defending all actions. A legal dysfunction system that condones it. I do not encourage civil disobedience, but I do encourage self defense at ALL costs. Too bad he didn’t have 360-degree motion lights, wireless cameras mounted with DVR, three Dobermans and his safety OFF. Deterrence always stops assassinations. So does resistance.

    As an OIF veteran myself, it saddens me to hear of the loss of a brother in arms. However, while the story sounds tragic on the surface, I think it would behoove all of us to wait until ALL the facts come out, rather than rushing to judgement based on a brief news blurb that was noticeably short on information.

    The sad thing was he was apparently still alive after that and they denied him paramedic attention, for about an hour, till he he passed. I doubt the paramedic’s really could have done anything… but refusing him aid, is just one more thing that wreaks of the TPDs irresponsible behavior.

    Furthermore, if this so-called SWAT Team were Muslims then we would call them terrorists! There are no differences. Conveniently the judge “seals” the evidence or lack of. And Pima County Sheriff is upset that media questions the legality? Get over yourself. 60-shots to kill a lone Marine in his house is a bit much to justify. We go to war to defend the freedoms that these pukes abuse in their uniformed assassinations. They should be prosecuted for Capital Murder! And they’re obviously piss poor shots.

It’s called the constitution but apparently that doesn’t seem to get in their way, can you imagine the uproar there would be if Bin Laden was shot 60 times, there would be all kinds of investigations and questions of legality and justification!!
