Sweepstakes – Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
To Enter: Pick up a copy of the Fall issue of Guns of the Old West or the Summer/Fall issue of Personal Defense World or Summer/Fall issue of Concealed Carry or the November/December Tactical Life or the November/December issue of Combat Handguns or the Winter issue of Ballistic Magazine and follow the directions on completing the survey. Enter anytime between August 1, 2018 and January 31, 2019 (“Sweepstakes Period”), and take the Survey. All entries must be received by 11:59 PM ET January 31, 2019. Entrants are responsible for determining the corresponding time zone in their respective location, for online entry deadline. By entering, participant agrees to receive future email newsletter(s) and offers from Athlon Outdoors or any one of its media properties; you will have the opportunity to opt-out in each communication.
Drawing(s): Exactly thirty (30) winners will be selected via random drawing(s) from among all eligible cumulative entries received during the Sweepstakes Period. Entrants must have completed the full survey and in order to win. Drawing(s) will be conducted on or around February 5, 2018 by Athlon Outdoors (“Publisher”), using the Random.org random selection engine. Prize winners will be contacted by Publisher, or its designated agent, via email. If any mail is returned as undeliverable without a forwarding address, a potential winner cannot be contacted within 10 days of the first attempt to contact him/her, or if the potential prize winner is deemed ineligible for any other reason in Sponsor’s sole discretion, the potential prize winner will be disqualified and an alternate prize winner will be selected in his/her place by random drawing amongst all remaining eligible entries received.
Prizes:
Each winner (30 total) will receive one (1) backpack filled with various prizes. Totaled value of each prize package is under $599.
Prizes may not be transferred or redeemed for cash, in whole or in part. No substitution for prize permitted, except by Sponsor in the event of unavailability.
Eligibility: The Sweepstakes is open only to legal residents of the United States who are at least eighteen (18) years of age at the time of entry. Not open to employees of any Athlon Outdoors, Inc., their subsidiaries, respective affiliates, advertising, promotion, and public relations agencies, and their immediate families as well as individuals living in the same households of such employees. Entrants agree to the release of their name, address, and email information to Publisher and/or Sponsor for winner notification purposes and for public winner disclosure, as required by law. By entering the Sweepstakes, participants agree to be bound by the Athlon Outdoors privacy policy. Sweepstakes is void where prohibited, and is subject to all applicable Federal, State, and local laws and regulations. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all entries made by, or associated with, the applicable entrant. In the event of a dispute over who submitted any entry, the authorized subscriber of the email account provided in connection with the entry, as of the actual time that such entry was received by Sponsor, will be deemed to be the entrant. The “authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may require an entrant to provide proof of being the authorized account subscriber, which must be provided or else that entrant may be disqualified.
Limitation of Liability: Sponsor, Publisher, and their promotion partners are not responsible for printing or typographical errors in any Sweepstakes-related materials; or for any individual’s inability to enter the Sweepstakes, including but not limited to unavailable network, server, or other connections; failed software or hardware transmissions; other errors of any kind, whether human, mechanical, or electronic; or for any damage to any computer related to or resulting from participation. Multiple entries beyond what’s stated in section 1 above and those generated by script, macro, or other automated entry devices are not valid, and will be disqualified. Sponsor reserves the right to cancel or modify the Sweepstakes should any of the foregoing occurrences corrupt or impair the administration, security, fairness, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. If the Sweepstakes is cancelled for any reason, including but not limited to those listed above, winners will be determined via random drawing from all eligible entries received up to the time of Sweepstakes cancellation. By submitting an entry, entrants agree to these Official Rules and to all decisions of Sponsor, or its designated agent, which are final and legally binding in all respects, and further agree that all prizes are awarded upon the condition that Sponsor and its affiliates, subsidiaries, officers, directors, principals, employees or agents shall have no liability whatsoever and shall be held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any prize, or participation in this Sweepstakes or participation in any Sweepstakes-related activities, and further acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to its merchantability, quality, mechanical condition or fitness for a particular purpose. Sponsor reserves the right, in its sole discretion, without prior notice and at any time, to cancel, terminate or suspend this Sweepstakes, or any portion thereof, should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, integrity or security of the Sweepstakes (including but not limited to attempts to hack into or otherwise tamper with underlying source code/programming of the Sweepstakes). No portion of the Prize may be listed or offered for sale on eBay, Craigslist, or similar websites. By accepting prizes, winner agrees that Sponsor may use each winner’s name, likeness, photograph and/or biographical information, without limitation, for promotional purposes without further consideration or payment, where permitted by law. Taxes on and in connection with all prizes are the sole responsibility of each winner. Prizes are not transferable. No prize, cash or other substitutions allowed except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect. In the event that this Sweepstakes is challenged by any legal or regulatory authority (including but not limited to any federal or state governmental authority), Sponsor reserves the right to discontinue or modify the Sweepstakes, as applicable, or to disqualify any entrants residing in any affected geographic areas, as applicable. In such event, Sponsor shall have no liability to any entrants who are disqualified due to such an action.
Dispute Resolution: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF TENNESSEE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Nashville, Tennessee having jurisdiction. Further, in any such dispute, under no circumstances will a participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
